Your right to compensation under EU 261/2004

EU 261/2004 protects air passengers. If a flight departing from the EU — or operated by a European carrier — is delayed, cancelled, or you face denied boarding, you may be entitled to financial compensation. The rules also cover other forms of help: refreshments, the means to communicate, and in some cases overnight accommodation.


Air Malta compensation for a delayed flight

If you flew with Air Malta and your flight is delayed by more than three hours, you may be entitled to compensation. Worth checking that the delay wasn’t caused by extraordinary circumstances like extreme weather or a strike — in those cases the payout doesn’t apply.

Air Malta, like every airline operating in the EU, has to follow EU 261/2004 and pay out when the conditions are met.


Air Malta compensation for a cancelled flight

If your flight was cancelled less than 14 days before departure, you may be entitled to compensation. Worth checking whether the airline offered an adequate rerouting or whether the cancellation was caused by extraordinary circumstances.

When you’re entitled to compensation

You’re entitled when the flight is delayed by more than three hours, cancelled, or hit by overbooking. You’re not entitled when:

  • The delay or cancellation was caused by extraordinary circumstances (natural disasters, strikes outside the airline’s control).
  • You were told about the cancellation more than 14 days in advance.
  • You were offered an adequate rerouting.
  • You’re flying a non-European airline from a destination outside the EU.
